Welcome to Iron Icon. The terms "we", "us" and "our" refer to Iron Icon.
Iron Icon operates this store and website, including all related
information, content, features, tools, products and services in order to
provide you, the customer, with a curated shopping experience (the
"Services"). Iron Icon is powered by Shopify, which enables us to provide
the Services to you.

The below terms and conditions, together with any policies referenced
herein (these "Terms of Service" or "Terms") describe your rights and
responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important
information about your legal rights.

By visiting, interacting with or using our Services, you agree to be bound
by these Terms of Service and our Privacy Policy
(https://ironiconactivewear.co.uk/policies/privacy-policy). If you do not
agree to these Terms of Service or Privacy Policy, you should not use or
access our Services.

Nothing in these Terms affects your statutory rights as a consumer under
the Consumer Rights Act 2015, the Consumer Contracts (Information,
Cancellation and Additional Charges) Regulations 2013, or any other
applicable UK consumer protection law.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you confirm that you are at least 18
years old, and that you consent to any minors in your care using the
Services on devices you own, purchase or manage.

To use the Services, including browsing our online store or purchasing any
of the products we offer, you may be asked to provide certain information,
such as your email address, billing, payment and delivery details. You
confirm that the information you provide is correct, current and complete,
and that you have all rights necessary to provide it.

You are responsible for keeping your account details secure. You may not
transfer, sell, assign or license your account to anyone else.

SECTION 2 - OUR PRODUCTS

We make every effort to represent our products accurately. Please note that
colours and appearance may differ slightly from how they appear on your
screen, depending on your device and its settings.

All product descriptions are subject to change at any time. We may
discontinue any product at any time, and may limit the quantities of any
product we offer to any person or region.

None of the above affects your statutory rights. Under the Consumer Rights
Act 2015, the goods we supply must be of satisfactory quality, fit for
purpose and as described. If they are not, you are entitled to a repair,
replacement or refund as set out in that Act and in our Refund Policy
(https://ironiconactivewear.co.uk/policies/refund-policy).

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Iron Icon may
accept or decline your order at our discretion. A contract is formed only
when we confirm that your order has been accepted and dispatched. We must
receive and process your payment before your order is accepted.

Please review your order carefully before submitting it, as we may not be
able to change or cancel it once it has been dispatched. If we do not
accept, change or cancel an order, we will contact you using the email
address or phone number provided at the time of the order, and refund you
in full where payment has already been taken.

Your right to cancel, return or exchange is set out in our Refund Policy
(https://ironiconactivewear.co.uk/policies/refund-policy) and in the
Consumer Contracts Regulations 2013.

Our products are intended for personal use. We may decline orders that
appear to be for commercial resale.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price
charged will be the price in effect when your order is placed, as set out
in your order confirmation email.

Prices shown include UK VAT where applicable. Delivery charges are shown
separately at checkout. For orders shipped outside the UK, you may be
responsible for customs duties or import charges, which are not included in
our prices.

From time to time we may run promotions governed by their own terms. Where
those terms conflict with these Terms, the promotion terms will apply.

You agree to provide accurate payment and account information, and to keep
it up to date so we can complete your transactions and contact you when
needed. You confirm that you are authorised to use the payment method you
provide.

SECTION 5 - DELIVERY

All delivery times given are estimates. We aim to dispatch orders within
1-3 working days.

Under the Consumer Contracts Regulations 2013, unless we have agreed a
longer period with you, we will deliver your order within 30 days of the
contract being formed. If we cannot, you may cancel the order and receive a
full refund.

Risk of loss or damage to the goods passes to you when the goods come into
your physical possession, or the possession of someone you have nominated
to receive them. If your order is lost or damaged in transit, message us on
Instagram at @ironiconactivewear or email
support@ironiconactivewear.co.uk and we will resolve it.

We are not responsible for delays caused by circumstances outside our
reasonable control, but we will keep you informed and you retain the rights
described above.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, text, displays, images,
graphics, video and audio, and the design, selection and arrangement of
them, are owned by Iron Icon, its affiliates or licensors, and are
protected by UK and international intellectual property law.

These Terms permit you to use the Services for your personal,
non-commercial use only. You must not reproduce, distribute, modify, create
derivative works of, publicly display, republish, download, store or
transmit any of the material on the Services without our prior written
consent. Nothing in these Terms grants you a licence or rights under any
patent, trademark, copyright or other intellectual property of Iron Icon,
Shopify or any third party. All rights not expressly granted are reserved.

The Iron Icon name, logo, product names, designs and slogans are trademarks
of Iron Icon. You must not use them without our prior written permission.
Shopify's name, logo, product names, designs and slogans are trademarks of
Shopify. All other trademarks on the Services belong to their respective
owners.

SECTION 7 - OPTIONAL TOOLS

You may be given access to third-party tools through the Services, which we
neither monitor nor control.

You acknowledge that we provide access to such tools "as is" and "as
available", without warranties or endorsement. Your use of any optional
third-party tool is at your own discretion, and you should make sure you
are familiar with the terms on which that provider offers it.

We may offer new features or tools in future. These will also form part of
the Services and be subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain links to websites operated by third parties. We
are not responsible for the content or accuracy of third-party materials or
websites. If you leave our Services to access them, you do so at your own
risk.

transacting with them. Complaints or questions about third-party products
and services should be directed to that third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Iron Icon is powered by Shopify, which enables us to provide the Services
to you. However, any sales and purchases you make in our store are made
directly with Iron Icon. By using the Services, you acknowledge and agree
that Shopify is not responsible for any aspect of any sales between you and
Iron Icon, including any injury, damage, or loss resulting from purchased
products and services. You hereby expressly release Shopify and its
affiliates from all claims, damages, and liabilities arising from or
related to your purchases and transactions with Iron Icon.

SECTION 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our
Privacy Policy
(https://ironiconactivewear.co.uk/policies/privacy-policy), and certain
personal information may be subject to Shopify's Privacy Policy
(https://www.shopify.com/legal/privacy/app-users). By using the Services,
you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes
personal information about your access to and use of the Services in order
to provide and improve them. Information you submit may be transmitted to
and shared with Shopify and third parties that may be located outside the
UK, in order to provide the Services to you. See our Privacy Policy for
details of how we, Shopify and our partners use your personal information.

If you contact us through Instagram, your message is also processed by Meta
under its own terms and privacy policy, which we do not control.

SECTION 11 - FEEDBACK AND REVIEWS

If you submit any ideas, suggestions, feedback, reviews, photographs,
proposals or other content ("Feedback"), you grant us a perpetual,
worldwide, sub-licensable, royalty-free licence to use, reproduce, modify,
publish, distribute and display that Feedback in any medium, including for
marketing purposes.

You confirm that: (i) you own or have all necessary rights to the Feedback;
(ii) you have disclosed any compensation or incentive received in
connection with it; and (iii) it complies with these Terms. We are under no
obligation to keep Feedback confidential, to pay for it, or to respond to
it.

We may, but are not obliged to, monitor, edit or remove Feedback that we
consider unlawful, offensive, threatening, defamatory, obscene or otherwise
objectionable, or which infringes anyone's rights.

You agree that your Feedback will not infringe the rights of any third
party, will not be unlawful, abusive or obscene, and will not contain
viruses or malicious code. You must not use a false email address or
impersonate anyone. You are responsible for the Feedback you submit.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be typographical errors, inaccuracies or omissions
relating to product descriptions, pricing, promotions, delivery charges,
transit times or availability. We reserve the right to correct any such
errors and to change or update information, or cancel orders, if any
information is inaccurate - including after you have submitted your order.

Where an order is cancelled for this reason, we will refund you in full.

SECTION 13 - PROHIBITED USES

You may use the Services for lawful purposes only. You may not use the
Services, directly or indirectly: (a) for any unlawful or malicious
purpose; (b) to breach any applicable law or regulation; (c) to infringe
our intellectual property rights or those of others; (d) to harass, abuse,
insult, defame, intimidate or harm any person; (e) to transmit false or
misleading information; (f) to use or re-use material that does not comply
with these Terms; (g) to send unsolicited advertising, spam or similar
solicitations; (h) to impersonate any person or entity; or (i) to engage in
conduct that restricts or inhibits anyone's use of the Services, or which
may harm Iron Icon, Shopify or other users.

You also agree not to: (a) upload viruses or malicious code; (b) reproduce,
duplicate, copy, sell or resell any part of the Services; (c) collect or
track other people's personal information; (d) spam, phish, pharm,
pretext, spider, crawl or scrape; or (e) interfere with or circumvent the
security features of the Services or any related website.

We may suspend or terminate your account if we reasonably determine that
you have breached these Terms.

SECTION 14 - TERMINATION

We may terminate this agreement or your access to the Services at any time
where you have breached these Terms, or where we reasonably need to do so.
You will remain liable for all amounts due up to and including the date of
termination. Termination does not affect any order already accepted, or
your rights in relation to it.

The following sections continue to apply after termination: Intellectual
Property, Feedback and Reviews, Termination, Disclaimer of Warranties,
Limitation of Liability, Severability, Waiver and Entire Agreement,
Assignment, Governing Law, Privacy Policy, and any other provisions that by
their nature should survive.

SECTION 15 - DISCLAIMER OF WARRANTIES

The information presented on the Services is made available for general
information purposes. We do not warrant that it is complete, accurate or
up to date, and any reliance you place on it is at your own risk.

The Services themselves are provided "as is" and "as available". We do not
guarantee that your use of the Services will be uninterrupted, timely,
secure or error-free.

This section applies to the website and the information on it. It does not
apply to the goods we sell, which must be of satisfactory quality, fit for
purpose and as described under the Consumer Rights Act 2015. Nothing in
these Terms excludes or limits your statutory rights as a consumer.

SECTION 16 - LIMITATION OF LIABILITY

We are responsible to you for foreseeable loss and damage caused by us. We
are not responsible for loss or damage that was not foreseeable at the time
the contract was formed.

We do not exclude or limit our liability in any way where it would be
unlawful to do so. This includes liability for:

- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of your legal rights in relation to the goods, including the right
  to receive goods that are of satisfactory quality, fit for purpose,
  as described, and supplied with reasonable skill and care;
- defective products under the Consumer Protection Act 1987.

We are not liable for business losses. If you use our products for any
commercial or business purpose, we will have no liability to you for any
loss of profit, loss of business, business interruption or loss of business
opportunity.

Subject to the above, our total liability to you in connection with any
order will not exceed the amount you paid for that order.

SECTION 17 - YOUR LIABILITY TO US

If you breach these Terms, or use the Services unlawfully, you agree to
compensate us for any losses, damages, liabilities or claims - including
reasonable legal costs - that we suffer as a direct result.

This section does not apply to you as a consumer acting outside the course
of a business, except where your breach was deliberate or unlawful. Nothing
in this section affects your statutory rights.

SECTION 18 - SEVERABILITY

If any provision of these Terms is found to be unlawful, void or
unenforceable, that provision will be enforceable to the fullest extent
permitted by applicable law, and the unenforceable part will be severed.
This will not affect the validity of the remaining provisions.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms
does not constitute a waiver of that right or provision.

These Terms, together with any policies posted on this site, constitute the
entire agreement between you and us regarding your use of the Services, and
supersede any prior agreements or communications between us, including any
previous versions of these Terms.

SECTION 20 - ASSIGNMENT

You may not transfer or assign these Terms, or any of your rights or
obligations under them, without our prior written consent. We may transfer
or assign these Terms and our rights and obligations, provided this does
not affect your rights under them.

SECTION 21 - GOVERNING LAW

These Terms of Service, and any dispute or claim arising out of or in
connection with them, are governed by the law of Scotland. You and Iron
Icon agree that the courts of Scotland will have jurisdiction.

If you live elsewhere in the United Kingdom, you may also bring proceedings
in the courts of the part of the UK in which you live, and the mandatory
consumer protection law of that jurisdiction will continue to apply to you.

SECTION 22 - HEADINGS

The headings in this agreement are for convenience only and do not affect
the interpretation of these Terms.

SECTION 23 - CHANGES TO TERMS OF SERVICE

You can review the most current version of these Terms of Service at any
time on this page.

We may update, change or replace any part of these Terms by posting updates
to our website. We will notify you of any material changes in accordance
with applicable law, and those changes will take effect on the date
specified in the notice. Changes will not apply retrospectively to orders
already placed.
